ST. PAUL (WCCO) — A settlement has been reached in a lawsuit filed against Ramsey County by a former Metro Gang Strike Force deputy, according to the deputy’s lawyer.

On May 17, 2011, the Ramsey County Board voted to approve a settlement that paid Deputy Christopher Tayson and his attorney’s $82,500, according to a press release released Tuesday.

On Oct. 13, 2010, Tayson brought a suit against Ramsey County, Sheriff Robert Fletcher and Chief Deputy David Metusalem, and accused them of publicly stating or implying that he had improperly obtained property or cash during his tenure with the Strike Force. As a result, Tayson was suspended for the alleged conduct.

Tayson alleged that the Defendants made these public statements in order to deflect negative political opinion toward Fletcher, who was the fiscal agent of the Strike Force when the property and cash allegedly went missing.

Tayson has always denied that he did anything wrong and has always maintained that the Defendants’ motives were purely political, Tayson’s attorney said.

In 2005, Tayson was named Minnesota’s “Officer of the Year” as well as Ramsey County “Deputy of the Year.” He also received the “Medal of Valor” for apprehending a felon.

In addition to the $82,500, Tayson received back pay for the time he was placed on suspension.

As state and local governments continue to face fiscal challenges, it is vital that the quality of and access to core services is maintained without increasing the cost to taxpayers. Implementing shared services programs offers local governments an innovative way to achieve this goal. The Chamber is committed to supporting our public partners that share services. 17. What should be done to address the impact the Central Corridor Light Rail Transit (CCLRT) and its construction is having on local businesses and the community?

Metro Gang Strike Force Lawsuit

A class action lawsuit has been filed against the Metro Gang Strike Force (MGSF) alleging a number of constitutional and civil rights violations against innocent victims. Many of the people have been targeted and profiled on the basis of their national origin, race, and color of their skin.
Background:

It is alleged that the Strike Force engaged in a deliberate, repeated pattern and practice of using their apparent authority as police officers to extort cash and property from people coming in contact with the Strike Force.*MGSF Officers would often call the impound lot and ask if there were any iMexicansi there attempting to pick up vehicles. MGSF Officers would then show up at the impound lot, detain and search the individual, seize cash, the vehicle for forfeiture, or both; then, send the individual on his or her way without a receipt for the taken property.

MGSF Officers also engaged in the repeated practice of taking cash and personal property out of the homes of those on whom the police were serving a warrant, even though the cash or personal property was neither contraband nor evidence, nor listed in the warrant as items to be seized. MGSF Officers would then take the seized items without providing a receipt or inventory for the taken property. MGSF Officers also seized vehicles and property without providing individuals with due process and with proper notice, in their native language.

One of St. Paul's oldest and most famous family-run restaurants is about to triple in size, thanks to a boost from city coffers.

The city's Housing and Redevelopment Authority on Wednesday approved a controversial plan to support a $10 million expansion of Cossetta Italian Market and Pizzeria with $2 million in city loans and other public assistance, as well as a partial exemption from the city's "Living Wage" ordinance.

Under a deal brokered with the city, Dave Cossetta will pay 75 percent of his employees a living wage, instead of all of them. Financial penalties will apply if he fails to abide by the terms of the "forgivable loan" and tax-increment financing agreement.

The deal is expected to create 100 permanent new jobs at the West Seventh Street restaurant. With construction expected to get under way in June, Cossetta's century-old family business will nearly triple in size, adding a wine shop, a rotisserie and a rooftop restaurant and bar.

"We got what we needed to get out of this," said a visibly relieved Dave Thune, city council member and director of the HRA, in an interview afterward. "The development will be nothing short of incredible....One of our jobs is to create jobs, but it's not just to create jobs for computer analysts."

The city's 2011 living-wage standard is $13.98 per hour without health insurance benefits, or $11.82 per hour with the benefits. Cossetta has said most of his employees currently make at least $11.82 an hour and

Among the critics was Bernie Hesse, an organizer with UFCW 1189, which represents 12,000 unionized workers in Minnesota, Wisconsin and North Dakota, many of them in retail, manufacturing and food processing industries.

Council member Melvin Carter played a key role in fine-tuning the agreement, which has been voted on in stages by the council and the HRA. He said the plan will help create, by the year 2015, 100 permanent new jobs in a "soft economy" while establishing "financial disincentives" against failing to reach the 75 percent mark.

"When we voted for the (living wage) waiver, we did that with the very strong commitment that 75 percent of all the jobs be above a living wage," Carter said.

Stark, however, said the penalties for failing to reach the 75 percent mark were not strong enough.

"I'm not going to support the effort," Stark said. "Even if they only hit 50 percent or 45 percent, they'd still get a decent chunk of the money."

The HRA approved a $1.17 million forgivable loan and a $437,000 market-rate loan on April 13. The deal requires Cossetta to meet two conditions as of 2015: that he maintain at least 180 full-time employees, and that 75 percent of them be paid a living wage. If he fails either condition, then half his forgivable loan will be penalized proportionately. If he fails both conditions, the entire loan will be penalized.

In addition, property taxes generated by the expansion and other TIF districts throughout the city are being lent back to Cossetta in advance of construction through tax-increment financing. The package approved Wednesday includes a $388,000 pay-as-you-go TIF loan at an interest rate of 6.5 percent, payable over nine years.

His TIF payments are subject to the same sliding-scale penalties as the forgivable loan. In addition, if Cossetta fails to maintain half his full-time workers at a living wage, the city will forfeit his entire tax-increment financing loan payment for that six-month period.

Cossetta is working with Western Bank on a $6 million real estate loan, in addition to $1.3 million from his restaurant's own cash contributions. The company currently employs 112 to 127 workers.

"He's built this thing from nothing into a dream. I knew him when he was a teenager working for his grandpa," Thune said, adding that negotiating the expansion has been taxing. "Boy, it's been a struggle."

The city of St. Paul will pay a St. Paul woman $270,000 to settle an alleged case of police brutality under a proposed agreement expected to be approved today by the city council.
The plaintiff, Cosetta Morris, 35, maintained that an officer used excessive force when he attempted to break up her domestic dispute with her roommate and tossed Morris across the room, causing her arm to go through a glass door. She needed surgery to repair tendon damage. The city has admitted no wrongdoing.
The payout is one of St. Paul's larger, though not the largest, settlements of a police misconduct case.
The incident occurred March 15, 2009, and Morris was later convicted of interfering with a 911 call, a misdemeanor.
Her roommate had called police for help, and officer Adam Bailey and his partner arrived at their Minnehaha Avenue apartment at 9 p.m.
What happened after that depends upon which side you ask.
According to Morris' civil suit, officers arrived to find the roommate seated on a couch, with Morris pressed against her, holding her in place and attempting to remove a ring from her finger. "(The roommate) was screaming at this time," reads Morris' complaint.
Bailey told Morris to get off her, and according to the suit, "before (Morris) could comply, (Bailey) forcefully grabbed her from behind and violently and unlawfully flung her to the floor in an uncontrolled manner."
As a result, her left arm went through a glass pane of a French door leading

to an adjoining room. Bailey then turned her over, placed his knee on her back and "held her face down as she continued to bleed," the suit states.
His partner escorted the roommate from the apartment, and Morris was taken to Regions Hospital in St. Paul to be treated for damaged tendons. She underwent surgery several days later. Morris, a pension processor, had to miss months of work because of her injuries and incurred more than $21,000 in medical expenses, the suit states.
She had sought $1 million in damages and attorney's fees. She accused Bailey's partner of trying to convince the roommate that Morris had fallen through the glass as a result of tripping or struggling with Bailey. She also said Bailey's partner "further attempted to cover up (Bailey's) unlawful behavior by reporting that (Morris) was choking (her roommate)."
In a June 2009 response to the suit, city attorneys maintained that Morris' "alleged injuries and any damages sustained by (Morris) were proximately caused by her own acts or misconduct."
From his vantage point, Bailey maintained he could not tell whether Morris was removing her roommate's ring or doing something worse. As for later holding Morris down, that was a result of the fact she was struggling with him, according to the court filings.
"Officer Bailey alleges that at some point after Plaintiff sustained the injury to her arm, he had to turn Plaintiff over and place his knee in her back to gain control of her," the response states.
John Keating, a police spokesman, said the police department reviewed the facts of the case, and no internal disciplinary action was taken.
In June 2009, Morris was charged with interfering with a 911 call, fifth-degree assault and disorderly conduct, all misdemeanors. She pleaded guilty to interfering with a 911 call in October 2009 and was sentenced to a day in jail and one year of probation in addition to domestic abuse counseling and anger management treatment. The two other charges were dismissed.
A domestic abuse "no contact" order was lifted in December. Morris was represented by the law firm of Flynn, Gaskins and Bennett.
Only once has the city paid out a larger sum to settle a police misconduct case. In December 2005, the city paid $400,000 to the family of Charles Craighead, who was fatally shot by a police officer as he struggled with a carjacker in December 2001.
The previous record settlement was in 2004, when police paid $270,000 to Robert Kearney, who said officers broke his leg while taking him from a sober house to a detox center in May 2002.

Racially Based Code Enforcement Case reaches US Supreme Court

It is a sad reality that many communities use code enforcement to promote an illegal racially motivated agenda. The ACLU outlines their view of the problem in an article, Renting While Black.

We see it here in Milwaukee where at least one Alderman appears to use Aldermanic Service Requests in a way that only the ku klux klan would be proud of.

Even if so called community leaders are not actively involved in the racially motivated inspections, a complaint based code enforcement that permits anonymous exterior complaints opens the door for neighbors to promote their biases through code enforcement

There have been a number of federal lawsuits over the years alleging racially motivated code enforcement. A list of some of those cases can be found here.

Typically if a case gets to the point that the property owners may win the municipality quickly and quietly settles. Usually not for the full compensation for the harm caused by the racially motivated enforcement. But lets face it, it takes a lot of financial and mental tenacity for a small landlord to slug it out against cities with seemingly endless resources to defend their bad behavior.

However there is one such case that the landlords have held on for something like eight years now. After the Federal Eighth CIrcuit Court of Appeals issued an opinion favorable to the landlords, the city of St Paul has petitioned the US Supreme Court for review (link to petition for review). You can read the amended original complaint that started this case here.

If the Supreme Court hears this case it will have a huge impact on all landlords who follow fair housing practices, i.e. don’t reject tenants tenants simply because they are a different color, nationality, religion, etc than their neighbors. One must really respect these property owners for the amount of sacrifice they have made to get this far.

The case alleges that St Paul housing inspection programs were used in a racially motivated manner to force racial minorities out of St Paul and that such actions violated the Fair Housing rights of the occupants. A very interesting point is a number of city employees including inspectors are on the hook personally in this suit. From a legal perspective they must defend themselves as they and their employer have disparate interest; for the city to win if the allegations are proven true they must claim rogue employees acting outside of the law. For the inspectors to win they must argue that they were following instructions that they believed were legal. The inspectors may have a hard time claiming ignorance however as the owners had provided the inspectors with documentation that the inspectors’ acts were contrary to Fair Housing, yet the inspectors continued with their agenda. At some point the inspectors will have to name their union as third party defendants as the union failed to stop management from allowing/forcing them to violate the rights of the tenants and owners

From my conversations with two of the plaintiffs over the past six or seven years they seem to be just a handful of hard working landlords who independently found themselves on the losing end of government behaving badly. The current case is a consolidation of three or four cases that started independent of each other, but the claims were so similar that the federal court combined them.

Most of the cases claimed RICO (racketeering) on the part of the city employees. The RICO elements were dismissed due to procedural errors. I’m certain that some future case will go to trial on that issue, whether in St Paul or somewhere else.

It's hard to know when things went wrong at Lenny Anderson's home on McKnight Road in St. Paul.

The 70-year-old was storing a friend's camper, boat, water scooter and other items in his heavily wooded backyard when someone complained. The city got involved, and after a year of bickering, 10 Dumpsters and a recycling truck's worth of Anderson's and his friend's belongings were hauled out last week, bound for the landfill.

Anderson asserts the city overreacted; the city says it had to take whatever actions were necessary to clean up the property because of Anderson's continued violation of city ordinance.

"I feel very violated," said Anderson, who had a similar run-in with the city about a decade earlier. "They could've taken [some of the belongings] to the impound lot. They're inflexible."

After two complaints, the city inspected Anderson's land in April 2009 and asked him to clean it up. Anderson challenged the complaint, and appealed his case from the city level up to the state Supreme Court, which refused to hear it.

Things came to a head nearly a year -- and several warnings -- later when Anderson failed to meet the city's deadline, and the city decided it had to take matters into its own hands.

"He had his chance to remove it to somewhere compliant, and he failed to do so," said Angie Wiese, spokeswoman for the city's Department of Safety and Inspection. "The order [to clean up the property] says we will remove [items] from your property, not we will remove it and give it back to you later."

After exhausting his appeals, Anderson began clearing six large shipping containers, wood and steel beams from his backyard, which is not visible from the road. He asked for more time in July. The city agreed, but reinspections on Aug. 3 and Aug. 16 didn't show enough improvement, according to court documents.

The city sent Anderson a letter on Aug. 20, announcing its intention to "remove all items found not to be in compliance" on Sept. 8.

When the cleanup crew showed up, it was the manner of removal that agitated Anderson. He watched in horror as an excavator smashed, grabbed and dropped a boat, water scooter, camper, several metal trailers and other belongings into large Dumpsters.

Anderson and his attorney, James Roban, said it was the destruction and disposal of perfectly functional belongings that was unnecessarily malicious. They said that although they expected the cleanup crew, they didn't know so much property would be thrown away.

The city also discarded seemingly innocuous items, Anderson said, including a cast iron planter in his front yard that contained perennials, a park bench in the woods behind his home, $3,500 in firewood, a garden hose, and a large garbage can full of sand and salt for the winter.

Wiese said the only things the city impounds are titled, functioning vehicles. A truck was impounded and later reclaimed by Anderson.

"He had an opportunity to remove [his property] as he wanted," she said.

Anderson and the city went through a similar incident in 1999 involving some of the same items. The city hauled away some items that Anderson later reclaimed. The city billed him $25,000 for that job. It has estimated the most recent one at $30,000.

Anderson said he plans to sue the city for damages. He estimates his loss at $75,000 to $100,000.

"It says they can remove things," Roban said. "It doesn't say they can destroy anything. I don't think it's reasonable to destroy everything."

St. Paul Landlords Could Have The City Paying Millions

A legal battle between the City of Saint Paul and a handful of landlords could force the city to pay millions.

It all centers around code enforcement.

The city says it was trying to make sure housing is safe and sanitary. Landlords who are part of the suit say the city went too far, hurting their rental business, hurting people who need affordable housing.

Twelve St. Paul landlords claim the city's aggressive code enforcement forced them to make expensive unnecessary repairs. They say the enforcement also forced them to cut back or sell out and that hurt affordable housing in St. Paul.

St. Paul City Attorney Gerald Hendrickson says the city's goal was better housing.

A new court decision says it's possible the code enforcement caused a "disproportionate adverse effect" on "racial minorities." Affordable housing "decreased as a result." Wednesday's decision opens the door for a court fight. If the landlords win, one attorney told 5 EYEWITNESS NEWS, the city could be on the hook for millions.

When you can't sell a home that you've priced at $1, what's your next step?

Cut the price to 50 cents?

Try paying someone to take the house for a buck?

St. Paul officials have learned some disappointing — but not surprising — lessons four months into a project to sell a cluster of city-owned homes at prices ranging from $50,000 all the way down to a buck.

In August, the city's Housing and Redevelopment Agency sponsored a series of open houses for the HRA-owned properties clustered along the west end of Fourth Street in the Dayton's Bluff neighborhood. City officials said they would sell only to buyers who showed they could finance extensive repairs that satisfy both city rules and historic preservation guidelines.

But despite heavy turnout at the open houses, the city has received only three purchase proposals thus far, said Sheryl Pemberton-Hoiby of the city's Department of Planning and Economic Development. Only one of the proposals, she added, likely will result in a sale.

Potential buyers have been daunted by the scope of rehab work needed on the houses, said Ellen Biales, aide to City Council President Kathy Lantry. Another concern: Many of the properties lack off-street parking.

"People want garages," said Pemberton-Hoiby.

As the number of foreclosures has skyrocketed in recent years in the Twin Cities and across the country, cities like St. Paul have taken on the role of buying houses to address a sharp increase in

vacant properties. Those vacancies can contribute to a downward spiral in values for other homeowners in the neighborhood.

The result is that St. Paul now finds itself with not just the 11 homes in Dayton's Bluff, but another 59 properties spread across the city. About 30 of the homes likely will be demolished, but city officials hope to sell the others and promote neighborhood redevelopment efforts.

The Dayton's Bluff program — known as the Fourth Street Preservation Project — was meant to test strategies for how the city might best sell its homes. The key lesson learned thus far: More investment in rehabilitating the homes on the front-end is needed to entice buyers.

As one example, St. Paul is doing some initial surveying work to show potential buyers options for creating off-street parking at some of the Dayton's Bluff homes. The city also is considering improvements to exteriors and mechanical systems in the houses.

"People want to see the city's involvement — that they're not the only ones taking on the risk," Pemberton-Hoiby said.

With the additional investment, those $1 prices likely will be a thing of the past as the city looks to recoup the money.

In one respect, the city's effort has coincided with some helpful trends in the local housing market, where a lot of the activity among buyers has been focused on low-price homes.

Between December 2008 and last month, more than 12,000 homes priced at $120,000 or less have sold in the 13-county metro area, according to the Minneapolis Area Association of Realtors. That's a nearly 95 percent increase over the number of sales in that price bracket during the previous 12-month period.

Plus, there's been added incentive in recent months to purchase in Dayton's Bluff and nearby neighborhoods. In April, the Pohlad Family Foundation announced a $1 million grant to provide buyers in the 55106 ZIP code — an area that includes Dayton's Bluff — with $8,000.

But all of the foundation funds have now been committed, said Zong Vang of Dayton's Bluff Neighborhood Housing Services of St. Paul, the nonprofit group that is managing the grant money.

And the demand for low-price homes has been stoked by a huge supply of the properties, meaning buyers looking for discounted homes have had a lot of choices. The city's properties have been going up against some tough competition in the under-$100,000 price bracket, said Brad Griffith, an agent with Edina Realty who has worked with buyers and sellers on St. Paul's East Side.

Some buyers who've been looking for deals in homes priced at $25,000 to $40,000, Griffith said, wind end up opting for higher priced homes — say about $80,000 — when they see how the higher price tag translates into significantly less rehab work.

Griffith said he's not familiar with details of the Fourth Street Preservation Project, but suggested that city officials might want to consider working with local real estate brokers to market the homes. That way, the homes could be listed on the Regional MLS of Minnesota, a propriety database used by Realtors.

"The MLS is helpful from the exposure standpoint," Griffith said.

Better marketing would help the Fourth Street project, agreed Chuck Repke, executive director of the Northeast Neighborhoods Development Corp. But there have been other challenges.

Many recent buyers of homes under $120,000 are investors looking to rent the properties or sell them following rehabilitation. The city wants to sell to buyers who will live in the properties.

Repke said he agreed with the city's focus on owners who will be residents, but noted that those buyers constitute a much smaller group. Another challenge: Potential buyers are having trouble finding loans to finance the extensive rehab projects that are required to live in the Dayton's Bluff homes.

"I think you can stimulate people to buy St. Paul," Repke said. "Before all of the markets collapsed everywhere, we were finding people making that decision to come back to the urban core. ... If the credit market changes on some of this stuff, I think there will be buyers."

Pemberton-Hoiby, the city official who is project manager on the Fourth Street effort, said the city has not marketed the homes through the MLS because the sales come with so many strings attached in terms of rehabilitation requirements that the houses aren't standard listings. Even so, she said, the city is looking at ways it could compensate real estate agents for bringing buyers.

While city officials would have liked to have sold some of the 11 homes by now, Pemberton-Hoiby said the properties in Dayton's Bluff and those elsewhere in the city continue to offer chances at improving neighborhoods.

"Most of the properties we're picking up haven't been rehabbed in a long time," she said, "if at all."

[JURIST] Enforcement of various civil rights laws decreased during the Bush administration, according to a report [text, PDF; summary] released Thursday by the US Government Accountability Office (GAO) [official website]. The GAO studied the activities of the Civil Rights Division of the US Department of Justice (DOJ) [official websites] between 2001 and 2007. According to the report, DOJ lawsuits to enforce laws prohibiting race or sex discrimination in employment fell [NYT report] from about 11 per year under the Clinton administration to about 6 per year under the Bush administration. There was also a drop in the number of cases brought under the Voting Rights Act from more than four cases a year under Clinton to fewer than two cases a year under Bush. The US House of Representatives held a hearing [materials; recorded video] Thursday on oversight of the Civil Rights Division, at which GAO Director of Homeland Security and Justice Issues Eileen Regen Larence recommended [testimony, PDF]:

that to strengthen the Division's ability to manage and report on the four sections' enforcement efforts, the Acting Assistant Attorney General of the Division, among other things, (1) require sections to record data on protected class and subject in the Division's case management system in order to facilitate reporting of this information to Congress, and (2) as the Division considers options to address its case management system needs, determine how sections should be required to record data on the reasons for closing matters in the system in order to be able to systematically assess and take actions to address issues identified.

Assistant Attorney General Thomas Perez [official profile] said [testimony, PDF] that the DOJ is "working to comply fully with the GAO's recommendations."

In September, US Attorney General Eric Holder [official profile] said that the DOJ planned to expand its Civil Rights Division [JURIST report] and more actively enforce anti-discrimination laws. The increased focus on civil rights marks a change in focus from the previous administration, which, according to the New York Times [NYT report; JURIST report], shifted resources from preventing racial discrimination to protecting religious rights. Among the new measures described by Holder were President Barack Obama's plan to add more than 50 lawyers to the Civil Rights Division and increased enforcement of anti-discrimination laws in areas in which minorities are often adversely affected, including housing and employment. At his swearing-in ceremony, Holder pledged [JURIST report] to restore the traditions of fairness and neutrality to the department.

Eminent Domain for Private Gain

Arlington, Va.—The New York Court of Appeals, the state’s highest court, today announced that it would uphold the decision of the Empire State Development Corporation (ESDC) to condemn privately owned homes and small businesses to make way for wealthy developer Bruce Ratner’s so-called “Atlantic Yards” development of 16 mammoth skyscrapers centered around a basketball arena.

“Today’s decision puts homes and businesses throughout New York at risk of condemnation,” said Dana Berliner, a senior attorney at the Institute for Justice (IJ), which filed a friend-of-the-court brief in the case. “Courts have a duty to look carefully at the government’s claim that it has the right to take someone’s home or business, and the Court of Appeals has simply refused to do that.”

While upholding the taking, the New York court did not go so far as to embrace the United States Supreme Court’s much-maligned reasoning in the 2005 Kelo v. City of New London case, which held that the U.S. Constitution allows governments to condemn property for economic development alone. Instead, the Court found the takings were for a “public use” because of the ESDC’s determination that the area to be condemned was “blighted”—a determination that was based on a study paid for by the would-be developer and not even initiated until years after the Atlantic Yards project was announced.

In a dissent, Judge Robert Smith excoriated the majority for abandoning its duty to critically examine the ESDC’s assertions. “To let the agency itself determine when the public use requirement is satisfied is to make the agency a judge in its own cause,” Judge Smith wrote. “I think that it is we who should perform the role of judges, and that we should do so by deciding that the proposed taking in this case is not for public use.”

“The developer’s study did not find anything a normal person would call ‘blight,’” explained Berliner. “Instead, it found that the neighborhood was ‘underutilized’—in other words, that the developer could think of bigger things that could be built where these homes and businesses are. If that is all that is necessary for condemnation, then literally every piece of property in New York is at risk.”

The majority’s opinion frankly acknowledges that the court may be opening the door to “political appointees to public corporations relying on studies paid for by developers . . . [as] a predicate for the invasion of property rights and the razing of homes and businesses.” But, it says, preventing such abuses is not the job of the courts, advising New Yorkers to look to their legislature to fix any problems.

“New York is one of only seven states that has failed utterly to pass any kind of eminent-domain reform in the wake of the Kelo decision, and today’s opinion will only make things worse,” said IJ Staff Attorney Robert McNamara. “The state courts are looking to the legislature to fix the problem, while the legislature is apparently looking to the courts. And that means more and more New Yorkers will be looking at condemnation notices.”

“Property rights are as sacred to citizens of New York as they are to Americans nationwide, and New Yorkers have rightly looked to their courts to protect those rights,” concluded IJ President and General Counsel Chip Mellor. “Today’s opinion should be a clarion call to the state legislature that they cannot avoid this issue any longer. Now is the time to give state residents the reform and protections they desperately need.”

Expect a lot of action on St. Paul's West Side this week thanks to "Extreme Makeover: Home Edition." On Friday, it was announced that the Morris family — Sandy, Mychal and Catricia — were chosen by the ABC reality show to get a new home. While the family is off on a cruise courtesy of the show, thousands of volunteers have been working around the clock to complete the new home in less than 100 hours.

On Sunday, the house at 226 Prescott St. was demolished, and on Monday the basement had been poured, framing put in place and, in the afternoon, workers were racing against some iffy weather to complete the roof.

"We can work with a little drizzle," said Tom Budzynski, owner of TJB Homes — the Blaine company spearheading the building of the Morris' new 2,800-square-foot home that will include three bedrooms, three baths and a separate area for the day care center that Sandy Morris operates out of her home. "But if it downpours, the health and safety of the crew is more important than working."

Budzynski said the crew would have been two hours ahead of schedule, but they were held up a bit on Sunday due to some special guests. The Muppets have been on site (they will be back on Thursday), as part of the "Extreme Makeover's Get on the Bus" initiative that matches celebrities to a family. Miss Piggy had the honors of kicking down the last wall of the old Morris house, while Kermit ran the backhoe.

"They were cute," said Budzynski. "But they don't understand construction

And for football fans working on the house, Comcast was sending out a truck Monday night with multiple TVs and a sound system, so workers wouldn't have to miss the big Vikings/Packers game at the Metrodome.

Construction is scheduled to continue through Thursday when the designers get their chance to decorate. The family will get the keys to their new home on Friday afternoon.

If you want to see the house, a shuttle runs through Friday from 8 a.m. to 8 p.m. at the Signal Hills Center parking lot, 50 Signal Hills Center in West St. Paul. Spectators are encouraged to bring a non-perishable food item as admission to the site. There will also be a blood drive on Thursday and Friday at the Neighborhood House at the Wellstone Center, 179 Robie St. E., St. Paul. Summit Avenue in St. Paul has long been a showcase for venerable mansions that recall some of the grandest aspects of the city's heritage.

Now, "For Sale" signs along the street are getting old, too.

The market for million-dollar homes on Summit and across the metro area has been hit hard by a combination of factors that have made luxury home shoppers scarce.

The problems range from investment losses and economic insecurity among potential buyers to limited access to the jumbo mortgages often used to purchase upper-bracket properties, those who sell upper-end homes say.

The result: 11 $1 million homes were available for sale on Summit last week, including eight that had been on the market for more than 200 days. The accumulation of high-end homes for sale is not unique to Summit Avenue.

"Higher-priced homes are simply not moving," Matthew Jozoff, an analyst with J.P. Morgan Securities, said in a research note last month to investors in mortgage-backed securities.

He sees home prices hitting bottom in 2011. "However, prices on more expensive homes may not bottom out until 2012," he said, adding that prices could drop more than 60 percent from their peak.

Locally, the Minneapolis Area Association of Realtors agrees that a bottom for the million-dollar home marke

market was hot earlier this decade, borrowers could obtain jumbo mortgages with as little as zero to 5 percent down after clearing relatively lax standards in terms of credit score and documented income, Stenback said.

But that's all changed since the beginning of the credit crunch last year, which caused the secondary market in jumbo mortgages to dry up. Now, Stenback said, the vast majority of jumbo loans are being held in the portfolios of banks, which are requiring higher interest rates and bigger down payments. Lenders also are much more selective about whom they lend to and the collateral property.

"There's a much smaller number of people that can qualify for jumbo financing," he said.

Not only are lending standards tougher, but appraisals also have become more difficult, said Rathmanner, the Keller Williams agent. That's because new rules governing business relationships between lenders and appraisers have made it more likely for appraisals to come in low and potentially scuttle a purchase agreement, Rathmanner said.
